Consequences to the intransigence of Republican Senators started yesterday, with a decision tied 4 to 4 in Hawkins v. Community Bank of Raymore. When the Supreme Court is tied on a decision, the ruling of the lower court stands. It is as if the Supreme Court has been erased, on every decision they have a tied vote.
A tied vote was not possible when all nine judges were alive. By refusing to do their duty, and vote on Judge Garland's nomination to the Supreme Court, McConnell and his gang have in effect nullified the third branch of government.
Decisions in three other cases were not tied - see details in the SCOTUS Blog. Would it be accurate to say that McConnell has erased only 25% of the Supreme Court? That could equal thirty-one random cases in a normal court calendar.
The Supreme Court decides about 130 cases a year. Every week they must evaluate 130 cases to decide if they will be heard by the court, a burden normally divided between nine judges.
I believe that the Senators who are nullifying the Supreme Court are committing a form of treason, because they are deliberately denying justice and a fair hearing to numbers of appellants while at the same time crippling the work of the third branch of government. I do not believe in escalation of personal attacks on opposite political parties, and a review of my blog will show no demagoguery.
I do not know what else to call it but treason. If it isn't treason, what is it?
